Terms of Service

These Terms of Service govern your use of the Vortex Jiu Jitsu Academy website and your relationship with us as a student, parent or guardian, or visitor. Please read them carefully. By creating an account, signing up for a trial, purchasing a membership, or otherwise using our services, you agree to these terms.

1. Who we are

“Vortex,” “we,” “us,” and “our” refer to Vortex Jiu Jitsu Academy, located at 5132 Minton Rd #3, Palm Bay, FL 32907. You can reach us by phone at (321) 210-9085 or by email at coach@vortexbjj.com. “You” refers to the person agreeing to these terms and, where a minor is involved, the parent or legal guardian responsible for that minor. 2. Acceptance of these terms

By using our website, enrolling in a program, attending a class, or purchasing a membership or product, you confirm that you have read, understood, and agree to be bound by these terms and by our Privacy Policy. If you do not agree, please do not use our services.

You must be at least 18 years old to enter into these terms on your own behalf. A parent or legal guardian must agree to these terms on behalf of any participant under 18 and accepts responsibility for that minor’s conduct and obligations.

3. Membership and billing

Memberships are sold on a recurring basis. Unless stated otherwise at the point of sale, membership fees are billed automatically each billing cycle (for example, monthly) to the payment method you provide. Payments are processed by our third-party payment processor, Stripe; we do not store your full card details on our own systems.

By starting a recurring membership you authorize us, through Stripe, to charge your payment method on each renewal date until you cancel. Prices may change; we will give you reasonable advance notice of any price change before it takes effect, and continued membership after that date constitutes acceptance of the new price.

Cancellation. You may cancel your recurring membership at any time by contacting us at coach@vortexbjj.com or by phone. Cancellation stops future renewals. To avoid being charged for the next cycle, please cancel before your renewal date. We recommend cancelling at least a few business days in advance so we can process the request in time.

Refunds. Membership fees are generally non-refundable once a billing cycle has begun, because access to classes is made available for that period. We do not provide partial refunds for unused classes or unattended sessions. If you believe you were billed in error, contact us promptly and we will review the charge in good faith and correct genuine mistakes. A free or discounted trial class is offered as a one-time courtesy and does not create an ongoing membership or any obligation to pay until you choose to enroll.

4. Class participation, assumption of risk, and limitation of liability

Brazilian jiu-jitsu, Muay Thai, grappling, striking, sparring, and related physical training involve inherent and significant risks, including the risk of strains, sprains, bruises, cuts, joint and muscle injuries, broken bones, concussion, and, in rare cases, serious or catastrophic injury. By participating in any class, open mat, private lesson, seminar, competition, or other activity at Vortex, you acknowledge and voluntarily accept these risks.

You agree to train within your abilities, to follow instructor guidance and academy rules, to tap or otherwise signal early and often, and to inform an instructor of any injury, illness, or medical condition that could affect your safety or that of your training partners. You confirm that you are in adequate physical condition to participate and have consulted a physician if you have any doubt.

To the fullest extent permitted by Florida law, Vortex Jiu Jitsu Academy, its owners, instructors, employees, and agents are not liable for injuries, losses, or damages arising from your participation, except where caused by our gross negligence or willful misconduct. Where liability cannot be excluded by law, our total liability to you is limited to the amount you paid us in the three months preceding the event giving rise to the claim.

A separate written waiver and release of liability may be required before you train; signing or declining that document does not change your acceptance of these terms, and these terms do not replace any such waiver.

5. Code of conduct

Vortex is a respectful training environment for students of all ages and experience levels. By training with us you agree to treat instructors, staff, and fellow students with respect; to maintain proper hygiene and clean training attire; to train safely and within control; and to refrain from harassment, discrimination, intimidation, or violence outside of supervised, consensual training.

We may suspend or terminate membership or access, with or without refund of the current cycle depending on the circumstances, for conduct that endangers others, disrupts the academy, or violates these terms.

6. Minors, parents, and guardians

Several of our programs serve children and teenagers. A parent or legal guardian must enroll any participant under 18, agree to these terms on the minor’s behalf, and provide accurate contact and emergency information. Parents and guardians are responsible for their child’s conduct at the academy and for arranging supervised drop-off and pick-up according to our schedule.

By enrolling a minor, you consent to that minor’s participation in training and accept the risks described in Section 4 on the minor’s behalf.

7. Intellectual property

The Vortex name, logo, website design, text, photography, video, and other content are owned by Vortex Jiu Jitsu Academy or its licensors and are protected by intellectual property laws. You may view and use the website for your personal, non-commercial purposes only. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission, except as expressly allowed by law.

8. Photography and media

We occasionally photograph or record classes, events, and competitions for instructional and promotional use. If you do not wish you or your child to appear in such media, please let an instructor know in writing so we can make reasonable efforts to honor your request.

9. Disclaimers

Our website and services are provided “as is” and “as available.” While we work to keep information accurate and the site available, we do not warrant that the site will be uninterrupted, error-free, or free of harmful components, and we do not guarantee any particular training result, fitness outcome, or competitive performance.

10. Changes to these terms

We may update these terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. For material changes we will make reasonable efforts to provide additional notice. Your continued use of our services after changes take effect means you accept the revised terms.

11. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to these terms or our services will be subject to the exclusive jurisdiction of the state and federal courts located in Brevard County, Florida, and you consent to that jurisdiction and venue.
